Terms of Service

1. Acceptance of Terms
By accessing or using CertFetch (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.
2. What CertFetch Provides
CertFetch provides a secure document management and sharing platform for brokers, clients, and subcontractors to upload, store, manage, and share insurance-related documents.
CertFetch does not issue insurance, provide financial advice, verify the accuracy or validity of documents, or guarantee that documents meet regulatory or contractual requirements.
3. Regulatory & Compliance Responsibilities
CertFetch is not an insurer, insurance broker, financial adviser, or regulated records custodian.
Users—particularly brokers—are solely responsible for understanding and complying with any laws, licensing conditions, professional obligations, or record-keeping requirements that apply to their business.
Use of CertFetch does not replace or remove any obligation to maintain records outside the platform where required by law.
4. User Accounts
- You must provide accurate and current information when creating an account.
- You are responsible for safeguarding your login credentials.
- You must notify CertFetch immediately of any suspected unauthorized access.
- You are responsible for all activity that occurs under your account.
5. Documents, Ownership & Responsibilities
CertFetch does not claim ownership of documents uploaded to the Service. You retain ownership and responsibility for all content you upload.
You are responsible for:
- The accuracy, completeness, and legality of uploaded documents
- Ensuring documents are appropriate for their intended purpose
- Managing who has access to shared documents
- Meeting any regulatory or contractual obligations relating to documents
User-Controlled Deletion
Authorized users may delete documents or close accounts, subject to role permissions and linked account structures (such as broker-client relationships).
Deletion removes documents from normal access within the platform. Certain information (such as audit logs, security records, and compliance-related data) may be retained in accordance with our Privacy Policy and Data Retention Policy.
6. Subcontractor Uploads
Subcontractors may upload documents using secure, time-limited upload links. Uploaded documents are visible only to the requesting client and their linked broker. Subcontractors do not receive platform accounts or ongoing access.
7. Acceptable Use
You agree not to:
- Upload malicious, harmful, or unlawful content
- Attempt to gain unauthorized access to other accounts or data
- Interfere with platform security, integrity, or availability
- Use the Service for fraudulent or illegal activity
- Bypass plan limits, access controls, or usage restrictions
8. Plans, Trials & Payments
CertFetch may offer free plans, trials, and paid subscriptions. Features, limits, and pricing are determined by the selected plan and may change over time.
Paid subscriptions are billed in advance on a recurring basis unless cancelled. Fees are non-refundable except where required by law.
We may enforce plan limits automatically, restrict access to features, or suspend usage where limits are exceeded or payment fails.
9. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Planned maintenance, upgrades, or unforeseen outages may occur.
10. Security
CertFetch uses industry-standard security measures including encryption, secure authentication, access controls, and audit logging.
No system is completely secure. You acknowledge and accept the inherent risks of using online services.
11. Administrative & Emergency Access
CertFetch staff do not have routine access to customer documents. Limited administrative access may occur only where necessary to provide support, resolve technical issues, or respond to security incidents.
Any such access is time-limited, logged, and subject to internal controls, and may require customer approval depending on the circumstances.
12. Limitation of Liability
To the maximum extent permitted by law, CertFetch is provided “as is” and “as available”. CertFetch and its founders are not liable for:
- Loss of profits, revenue, or business opportunity
- Loss or deletion of documents resulting from user actions
- Incorrect, outdated, or misleading documents uploaded by users
- Compliance failures by users or third parties
- Issues arising from third-party services or infrastructure
13. Termination
We may suspend or terminate access to the Service where these Terms are breached, security is threatened, or continued use poses risk to the platform or other users.
14. Governing Law
These Terms are governed by the laws of New Zealand. Courts of New Zealand have non-exclusive jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of CertFetch after changes take effect constitutes acceptance of the updated Terms.
