Terms of Service

1. Acceptance of Terms
By accessing or using CertFetch (“the Service”), you agree to these Terms of Service. If you do not agree, you must not use the platform.
2. What CertFetch Does
CertFetch provides a secure platform for brokers, clients, and subcontractors to store, manage, and share insurance documents. We do not issue insurance, provide financial advice, or verify the accuracy of documents uploaded to the platform.
3. Regulatory Responsibilities
CertFetch is not an insurer, insurance broker, or financial service provider. CertFetch does not act as a regulated record-keeping system.
Brokers are solely responsible for meeting all regulatory obligations, including any required 7-year document retention under New Zealand or Australian law.
Deleting a document within CertFetch does not remove a broker’s legal obligation to retain their own business records outside the platform.
4. User Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the confidentiality of your login details.
- You must notify us immediately if you suspect unauthorized access.
5. Document Ownership and Responsibilities
CertFetch does not claim ownership over documents uploaded by users. You are responsible for:
- The accuracy of uploaded documents
- Who you share documents with
- Managing your own regulatory requirements
User-Controlled Deletion
You may delete your documents at any time. CertFetch does not retain deleted documents unless legally required to do so. Brokers must maintain their own regulatory archives outside the platform.
6. Subcontractor Uploads
Subcontractors may upload documents using secure upload links. These documents become visible only to the requesting client and their broker. Subcontractors do not gain access to the platform.
7. Acceptable Use
You agree not to:
- Upload malicious files or harmful content
- Interfere with the platform’s operation
- Attempt unauthorized access to other users’ data
- Use CertFetch for illegal or fraudulent activity
8. Payment Terms
If you subscribe to a paid plan, fees will be displayed at checkout and billed on a recurring basis unless cancelled. No refunds are provided for partial billing periods.
9. Service Availability
We aim for high uptime but do not guarantee uninterrupted access. Scheduled maintenance and unexpected outages may occur.
10. Security
CertFetch uses industry-standard security practices including encrypted storage, HTTPS connections, presigned AWS S3 links, and permission-based access control.
However, no system is completely secure. You use the Service at your own risk.
11. Limitation of Liability
CertFetch is provided “as is”. To the maximum extent permitted by law, CertFetch and its founders are not liable for:
- Loss of profits or revenue
- Loss of documents deleted by users
- Incorrect or outdated insurance documents uploaded by users
- Business losses caused by user error or mismanagement
- Data issues caused by third-party providers (AWS, Resend, Twilio)
12. Termination
We may suspend or terminate accounts that violate these Terms or pose security risks.
13. Changes to the Terms
We may update these Terms over time. Continued use of CertFetch constitutes acceptance of the updated Terms.
